JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-12-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 504, 506 of the Indian Penal Code.
The prosecution case is that the accused persons came to the house of the informant, abused and called his younger brother Makeshwar Yadav and when the informant went to enquire why they are calling his younger brother then co-accused Arjun Yadav gave farsa blow on the head of the brother of the informant. When the informant came to rescue then co-accused Mahesh Yadav assaulted with spade. The accused persons also assaulted the mother and daughter of the informant and gave threatening not to lodge the case against the accused persons.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.56284 of 2015 (2) dt.11-12-2015 2/2 petitioners that accusation against the petitioner No. 2 is of making assault with spade which is on non-vital part of the body. Moreover the injury report of the informant's side has not been brought on record.
A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Jamui P.S. Case No. 260 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
