The petitioner apprehends his arrest in Ara Town P.S. Case No.373 of 2017 registered under Section 7 of the EC Act. The Sub Divisional Agriculture Officer intercepted a vehicle bearing Registration No.BR 03 K 1268 on which 31 bags of DAP fertilizers were loaded.

The learned counsel for the petitioner submits that the petitioner is the owner of the vehicle and one Arvind Kumar the licensee of Alok Enterprises hired vehicle for carrying fertilizers. The driver was driving vehicle. Arvind Kumar purchased the fertilizer and got the receipt.

Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that the petitioner is the

No.63574 of 2017 (2) dt.11-01-2018 2/2 owner of the vehicle and vehicle was being driven by the driver, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Bhojpur, Ara in connection with Ara Town P.S.
