The petitioners apprehend their arrest in Mainatand P.S. case No. 117 of 2016 under Section 188, 382, 34 of the Indian Penal Code.

The informant named the petitioners and others and alleged that they all harvested the paddy crops from his field in spite of order passed in Cr. W. J. C. No. 426 of 2015 by the High Court.

The learned counsel for the petitioners submits that there is land dispute between both sides. No order was passed in Cr. W. J. C. No. 426 of 2015 and the learned counsel for the petitioner with the leave of court withdrew the writ petition in

Patna High Court Cr.Misc. No.63581 of 2017 (2) dt.12-01-2018 2/2 order to file representation before the authority. Considering the facts that there is bonafide land dispute between the parties, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Su divisional Judicial Magistrate, West Champaran, Bettiah in connection with Mainatand P.S. case No.117 of 2016, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
