JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 20-06-2016 Heard learned counsel for the petitioners and learned counsel representing the State.

The petitioners seek bail in connection with Purnahiya P.S. Case No. 38 of 2015 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 436, 427 of the Indian Penal Code, Section 27 of the Arms Act and Section 17 of C.L.A. Act.

Allegedly, 10-12 unknown miscreants armed with deadly weapon put fire in the office of brick kiln of the informant and caused firearm injury to Ram Naresh Maurya due to non payment of levy.

Submission is of false implication and that the petitioners are not named in the first information report, name of the petitioners has come on the basis of confessional statement of

Patna High Court Cr.Misc. No.16973 of 2016 (3) dt.20-06-2016 co-accused and except that and some criminal antecedent there is nothing against the petitioners. Co-accused Vikash Kumar @ Vikash Patel has already been allowed bail by another co-ordinate Bench of this Court and the petitioners are suffering in custody since 11.12.2015 but they have not been put on test identification parade.

Learned APP fairly submits that co-accused Vikash Kumar @ Vikash Patel has been allowed bail.

In the facts and circumstances stated above, the petitioners above named are directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheohar in connection with Purnahiya P.S. Case No. 38 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioners shall remain present on each and every date during trial and the default on two consecutive dates on their part without any reason shall disentitle the petitioners from privilege of bail.
