JUSTICE MOHIT KUMAR SHAH ORAL ORDER 30-01-2018 The learned counsel for the petitioner submits that since the present anticipatory bail petition is not maintainably in view of the judgment of the Hon'ble Apex Court reported in (2012) 8 SCC 730 (Lavesh vs. N.C.T. of Delhi), he may be permitted to withdraw this petition with liberty to approach the concerned Court for grant of regular bail.

The present petition is disposed off as withdrawn with liberty to the petitioner to approach the concerned Court for grant of regular bail.

It is further directed that in case the petitioner surrenders within a period of four weeks from today and applies for regular bail, the concerned court shall consider his prayer for bail on the same day and dispose off the same by a reasoned order considering the fact that the case dates back to the year 2006 and
