Petitioner is seeking anticipatory bail in connection with Jamui P.S. Case No.426 of 2018 registered for the offences punishable under Sections 366A/34 of the Code of Criminal Procedure.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case, however, learned APP for the State is present and has opposed the prayer for anticipatory bail as according to him, the statements of the victim girl under Section 164 Cr.P.C show that there are specific allegations against the petitioner. On perusal of the records, this Court finds that the

Patna High Court Cr.Misc. No.4057 of 2019(2) dt.04-02-2019 2/2 victim girl has made a categorical statement that this petitioner had committed rape upon her after lifting her in his vehicle. In the given facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner. The application is dismissed.
