JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named but in course of investigation, the name of petitioner surfaced in this case and witnesses stated that petitioner had solemnized his love marriage with daughter of the deceased but after marriage of the petitioner, deceased started selling his lands which caused annoyance to petitioner and committed the alleged crime. Petitioner subsequently arrested and confessed his guilt. Admittedly, none has seen the actual killing of the deceased and except the above stated circumstances, there appears to be nothing against the petitioner, who is languishing in jail custody since 15.07.2015.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.56689 of 2015 (2) dt.15-12-2015 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Sabour P.S. Case No. 22 of 2014.
