2. The present application has been filed seeking modification of one of the conditions set for grant of bail to the petitioner in terms of order dated 24.01.2012 in Criminal Revision No. 106 of 2012.
3. Learned counsel for the petitioner submitted that one of the conditions was that the petitioner shall physically present himself before the Probation Officer, Madhubani at least once a month and also as and when directed by him. Learned counsel submitted that the petitioner has taken admission recently in the four years B.Sc. Nursing course in R. V. College of Nursing which is in Bangalore in the State of Karnataka. Learned
Patna High Court Cr.Misc. No.62022 of 2017 (2) dt.10-01-2018 2/2 counsel submitted that the petitioner has taken admission in the session 2017-18 and, thus, pursuing his study at Bangalore it may not be possible for him to appear before the Probation Officer, Madhubani at least once a month.
4. Learned A.P.P. does not oppose the prayer.
5. Having considered the aforesaid, the Court deems it appropriate to modify the condition.
6. Accordingly, the petitioner shall be obliged to physically present himself before the Probation Officer, Madhubani whenever he comes home.
7. The application stands disposed off in the aforementioned terms.
