2. The petitioner has prayed for bail in connection with Birpur P.S. Case No.194 of 2024 registered for the offence punishable under Sections 308(5), 126(2), 109, 3(5) and 352 of the B.N.S. and Sections 27and 25(1-b)a of the Arms Act.

3. The allegation against the petitioner is that he has demanded Rs. 5 Lakhs as rangdari from the informant. Further allegation is that this petitioner has fired at the house of the informant. The gun shot injury hit the door and the bullet is still embedded in the door.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has

Patna High Court CR. MISC. No.57694 of 2025(4) dt.12-12-2025 2/2 committed no offence. From perusal of the F.I.R. itself it is clear that nobody has received injury. Petitioner is having criminal antecedent of five cases and in all the cases he is on bail. He languishing in judicial custody since 05.10.2024.

5. Learned APP appearing for the State has vehemently opposed the application for bail has submitted that from the possession of the petitioner, one country made pistol and two live cartridges were recovered.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Principal Sessions Judge, Begusarai in connection with Birpur P.S. Case No. 194 of 2024.
