The petitioner seeks pre-arrest bail in connection with Nokha P.S. Case No. 81 of 2019 for the offences alleged under Sections 467, 468, 409 and 420 of the Indian Penal Code. The accusation is that the petitioner, who is posed as Auxiliary Nurse and Midwife (ANM) at Primary Health Center, Nokha, Rohtas at Sasaram, on verification, her matriculation certificate, which was produced at the time of appointment, was found forged as per letter no. 1111, dated 15.04.2019, of Civil Surgeon-cum-Chief Medical Officer, Rohtas at Sasaram. Learned counsel appearing for the petitioner submits that in fact the petitioner was appointed as ANM in the year 1985 and since then she is discharging her duty, going to retire in the year 2020 and, earlier, certificate, regarding the

Patna High Court CR. MISC. No.55877 of 2019(2) dt.03-09-2019 2/2 qualification, submitted, at the time of appointment, was verified twice, but, with ulterior motive, the present case has been lodged. Petitioner has no criminal antecedent nor any complaint was received against her discharging duty as ANM. Learned Additional Public Prosecutor for the State opposes the prayer for pre-arrest bail.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Nokha P.S. Case No. 81 of 2019 shall be released on pre-arrest bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Rohtas at Sasaram, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
