JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-12-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 354, 379, 504, 506/34 of the Indian Penal Code. The prosecution case is that the daughter of the informant lodged Bathnaha P.S. Case No. 158 of 2015 levelling accusation under Sections 341, 323, 324, 498A, 504, 506, 34 of the Indian Penal Code against petitioner No. 1 when petitioner Nos. 2 to 4 are co-villagers of petitioner No. 1. It is alleged that all the accused persons assaulted the informant in the Court premises and petitioner No. 3 snatched Rs. 10,000/- from the pocket of the informant.
It is submitted by learned counsel for the petitioners that in the background of the case lodged by the informant's side at earlier point of time the accusation has been
Patna High Court Cr.Misc. No.56275 of 2015 (2) dt.11-12-2015 2/2 levelled with frivolous accusation. The accusation is omnibus and general against the petitioners and for the occurrence of 07.08.2015 the First Information Report was registered on 18.08.2015, though fardbeyan was recorded on 08.08.2015. Considering the delayed lodging of the case and the relationship between the parties, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Dumra P.S. Case No. 198 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
