Heard learned Counsel for the petitioners and learned APP for the State.

This application, for grant of anticipatory bail, arises out of Narpatganj PS case no. 84 of 2024, disclosing offences punishable under Sections 363, 365/34 of the Indian Penal Code.

The prosecution story, in brief, is that the petitioners along with other accused persons kidnapped the son of the informant.

Learned Counsel for the petitioners submits that informant is daughter-in-law of petitioner no. 1 and bhabhi of

Patna High Court CR. MISC. No.65158 of 2024(2) dt.13-11-2024 2/3 petitioner no. 2 and petitioner no. 3 is second wife of the husband of informant, who has also been made accused and he is in jail. Learned counsel further submits that there is dispute between husband and wife for a very long period of time and due to that, present case has been lodged by informant against her husband and in-laws. He also submits that the missing boy is major and might have gone somewhere else.

On the other hand, learned counsel for the informant vehemently opposed the prayer for anticipatory bail and submits that the petitioners along with husband of the informant kidnapped informant's son in order to grab the property. He also submits that some time back, petitioners' side had come to the informant and put pressure to sign the papers, relinquishing her right and the right of her son in the property. 6.

Regard being had to the submissions made on behalf of the parties and taking into consideration the fact that petitioners are the family members of the informant's husband, all the petitioners are ladies and the husband of the informant is already languishing in custody, I am inclined to grant the privilege of anticipatory bail to the petitioners. 7.

This application is, accordingly, allowed.

Let petitioners, abovenamed, in the event of their

No.65158 of 2024(2) dt.13-11-2024 3/3 arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Narpatganj PS case no. 84 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
