1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 109, 126(2), 115(2), 303(2), 352, 351(2) and 3(5) of the B.N.S., 2023.

Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that the accused persons including the petitioners came and Harendra assaulted him by Dabiya repeatedly on head, thereafter Ajit assaulted him by an iron rod on head causing injury, while

No.63896 of 2025(3) dt.12-11-2025 2/3 Nagendra assaulted his cousin brother by knife causing injury on his neck, further Satyanarayan assaulted Vijay by sword causing injury on leg and Devilal along with Raja snatched chain of his cousin brother, thereafter police was informed and injured were taken to hospital.

4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant on account of dispute relating to land. It is next submitted that from side of the petitioners, Rajepur P.S. Case No.59/2025 was instituted against the informant and his side. It is also submitted that the injury suffered by the injured has been opined to be simple in nature. It is further submitted that though Harendra is alleged to have assaulted the informant repeatedly by Dabiya on head but then the informant suffered one injury on head. It is also submitted that Nagendra is alleged to have assaulted the cousin brother of the informant by knife causing injury on neck but then from the injury report, it manifests that Ajay suffered abrasion on neck along with pain in left hand and abdomen but then all the injuries have been opined to be simple caused by hard and blunt substance. It is also submitted that petitioners are not criminals and they will not abscond rather will cooperate in the investigation to prove their innocence.

5. Learned A.P.P. for the State opposes the prayer for

Patna High Court CR. MISC. No.63896 of 2025(3) dt.12-11-2025 3/3 anticipatory bail of the petitioners but then fairly submits that the injury suffered by the injured has been opined to be simple as recorded in the case diary.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned trial court where the case is pending/successor court in connection with Rajepur P.S. Case No.58/2025, subject to the conditions as laid down under Section / 482(2) of the B.N.S.S.

7. However, it is made clear that in the event if the Investigating Officer of the case files an application before the learned trial court bringing to its notice that the petitioners despite giving assurance to this court is not co-operating in the investigation in that event the learned trial court shall be at liberty to cancel the bail bonds of the petitioners.
