JUSTICE MOHIT KUMAR SHAH ORAL ORDER 19-09-2024 The present writ petition has been filed seeking the following relief:- "1(i) For issuance of an appropriate writ to restrain the Circle Officer, Ramgardhawa, Respondent No. 5 from initiating any demolition drive with regard to demolishing the dwelling house of the petitioner, before passing final order in Encroachment Case No.05 of 2020-21."

2. At the outset, the learned counsel for the petitioner seeks a simple direction upon the respondent-State to appear in the title suit, filed by the petitioner, bearing Title Suit No. 97 of 2022,

Patna High Court CWJC No.13697 of 2024(2) dt.19-09-2024 2/2 which is pending consideration before the learned Court of SubJudge, Motihari at East Champaran.

3. Per contra, the learned counsel for the respondent-State submits that the respondent-State would definitely enter appearance in the aforesaid title suit, within a period of four weeks from today.

In view of the aforesaid, the present writ petition stands disposed off.
