====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-06-2020 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State through video conferencing.
Petitioner is in custody since 07.06.2018 and seeks bail in connection with Sessions Trial No.181 of 2018 arising out of Bajpatti P. S. Case No.322 of 2017 registered for the offences punishable under Sections 363, 366, 120(B) of the I.P.C.
According to prosecution case, the victim along with petitioner and several other persons had gone to take bath in river Ganga, but she did not return to her home. The victim happens to be daughter-in-law of the petitioner and the informant claimed that petitioner got eliminated the victim on
Patna High Court CR. MISC. No.66973 of 2019(5) dt.05-06-2020 2/2 account of some land dispute. The perusal of case diary goes to show that informant and some other witnesses supported the prosecution case, but Para-23 of the case diary goes to show that on the alleged date of occurrence, there was stampede in which several persons died.
Learned counsel appearing for the petitioner submits that petitioner is in jail custody since 07.06.2018 and except suspicion, there is nothing against him.
Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Sitamarhi in connection with Sessions Trial No.181 of 2018 arising out of Bajpatti P.
