ANJANA MISHRA ORAL ORDER 05-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 13.07.2019 in connection with Telhara P.S. Case No.84 of 2019 registered for the offence under Section 30(a)(d) of the Bihar Prohibition and Excise Act, 2018.

Learned counsel for the petitioner submits that the alleged recoveries of illicit country made liquor were made from the motorcycle and not from the conscious possession of the petitioner. It is further submitted that the petitioner is not having any criminal antecedent.

Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedents, let the petitioner, above named, be released on

Patna High Court CR. MISC. No.55645 of 2019(2) dt.05-09-2019 2/2 bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Additional District & Sessions Judge Cum Special Judge, Excise, Biharsharif, Nalanda, in connection with Telhara P.S. Case No.84 of 2019.
