The petitioner apprehend their arrest in Jhajha P.S. Case No.163 of 2017 registered under Sections 341, 323, 324, 354(A), 379, 504/34 of the Indian Penal Code.

The informant has named the petitioner along with other accused persons and made allegation that accused persons namely, Chhotu Murmu and Manoj Murmu assaulted him by rod on his head. Chhotu Murmu, Manoj Murmu and Matru Murmu assaulted his daughter-in-law. The petitioners are alleged to have taken away two different articles from the house of the informant. The learned counsel for the petitioner submits that the dispute arose due to land dispute. The petitioners are ladies. They

Patna High Court Cr.Misc. No.63570 of 2017 (2) dt.11-01-2018 2/2 are not alleged to have assaulted anybody. The allegation of theft is ornamental.

Considering the facts aforesaid and the nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Jamui in connection with Jhajha P.S. Case No.163 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
