This application has been filed for anticipatory bail. Learned counsel for the petitioner has informed this Court that merely summon has been issued in the complaint case and no non-bailable warrant has been issued till date. In above view of the matter, in view of the law settled in Criminal Miscellaneous Case No.51075 of 2014 disposed of on 14.05.2015 by a Single Judge Bench of this Court, this application would not be maintainable and, thus, is dismissed as such.

Patna High Court Cr.Misc. No.1112 of 2016 (3) dt.03-02-2016 2 / 2 Petitioner would be at liberty to surrender before the court below and seek bail. In such case, the court below will consider his application on its own merit without being prejudiced by the dismissal of this case.
