JUSTICE SHAILENDRA SINGH ORAL ORDER 01-09-2025 In the present writ petition, the petitioner has challenged the order dated 09.04.2025 passed by the Circle Officer, Lalganj (Respondent No. 4) in Mutation Case No. 3473/2024-2025, and has prayed for the issuance of a writ in the nature of certiorari for setting aside the said order. However, the petitioner has also challenged the said order before the DCLR, Hajipur, Vaishali, by way of a Mutation Appeal filed on 04.06.2025, which is still pending. The grievance of the petitioner is that no action is being taken by the concerned

Patna High Court CWJC No.13740 of 2025(2) dt.01-09-2025 2/2 DCLR in the said appeal, and it remains at the same stage as when it was filed.

2. As the petitioner has availed the statutory remedy available to him under the relevant provisions of the Mutation Act, there is no need to exercise the writ jurisdiction. Accordingly, the instant writ petition stands disposed of with a direction to the DCLR, Hajipur, Vaishali, to expedite the petitioner's appeal and decide the same on its merit within six months from the date of receipt of a copy of this order.
