ANJANA MISHRA ORAL ORDER 05-05-2016 Heard learned counsel for the petitioners and the learned counsel for the informant as well as the learned counsel appearing on behalf of the State.

The petitioners are apprehending their arrest in connection with Rajeev Nagar P.S. Case No.42 of 2015 for allegedly having committed the offences under Sections 419, 420, 406, 384 and 34 of the Indian Penal Code. The allegation against the present petitioners is that they have been giving threats and demanding Rangdari from the informant, who had purchased a piece of land from one Shanti Devi. It is further submitted that the present petitioners are the grandsons of said Shanti Devi, who after executing an

Patna High Court Cr.Misc. No.57770 of 2015 (3) dt.05-05-2016 2/2 agreement for sale of the land and after handing over possession could not execute the deed in favour of the informant for the reason that there was some acquisition proceedings by the Housing Board.

Considering the peculiar nature of allegation and also that one Meena Devi, mother of the present petitioners, and wife of Om Prakash Yadav, who is the son of said Shanti Devi, has been extended the privilege of anticipatory bail in Cr.Misc. No.57415 of 2015, vide order dated 20.1.2016, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Smt. Sangeeta Rani, learned Judicial Magistrate, 1st Class, Patna, in connection with Rajeev Nagar P.S. Case No.42 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
