JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 12-12-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks pre-arrest bail in connection with Sasaram (M) P. S. Case No.489 of 2013 registered under Sections 147, 148, 149, 353, 307, 435, 427, 337, 338 and 120-B of the Indian Penal Code and Section 3 of Prevention of Public Property Act.

It is submitted by the learned counsel for the petitioner that the name of the petitioner has been given in the first information report simply because he sat on dharna six days prior to the alleged date of occurrence on 10.05.2013. He submitted that save and except, the aforesaid allegation there is no other material

Patna High Court Cr.Misc. No.58384 of 2017 (2) dt.12-12-2017 2/2 to connect the petitioner with the alleged offence and merely on omnibus allegation made against 200-250 persons, the petitioner is apprehending arrest at the hands of police.

Learned Additional Public Prosecutor for the State has opposed the prayer for pre-arrest bail of the petitoiner. Considering the facts and circumstances of the case, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in Sasaram (M) P. S. Case No.489 of 2013, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today.
