The petitioner seeks bail in a case registered for the offences under Sections 376(D), 120B of the Indian Penal Code and Section 8 of POCSO Act and Section 3⁄4 of Immoral Trafficking Act.

The learned counsel for the petitioner submits that the petitioner is in custody since 09.10.2021, he is a person with clean antecedent, charge-sheet has been submitted and the informant alleges that on information, the house of the petitioner was raided and the boy and a girl were found in an objectionable condition and some objectionable articles were recovered, further, Shivam, the apprehended accused disclosed that he came for enjoyment, further the victim disclosed that she was at living at Patna called by named accused person who enjoyed with her, further it is alleged that the

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, from perusal of the allegation as alleged in the F.I.R., it would manifest that apprehended accused including the girl has not even alleged anything against the petitioner except that they were enjoying themselves in the house of the petitioner.

The learned A.P.P. vehemently opposes the bail application.

Considering the fact that the petitioner is in custody since 09.10.2021, he is a person with clean antecedent, charge-sheet has been submitted, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Teghara P.S. Case No. 275 of 2021.

The application stands allowed.
