JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but his name surfaced in this case in course of investigation and it was detected that the mobile location of the petitioner was found near the place of occurrence at the time of alleged occurrence. Moreover, one mobile set is said to have been recovered from conscious possession of the petitioner but the aforesaid mobile is not looted property of the present case. Petitioner does not have any criminal antecedent and is languishing in jail custody since 6.8.2015, but up till now he has not been put on Test Identification Parade.
Accordingly, the petitioner above named is directed
Patna High Court Cr.Misc. No.2667 of 2016 (2) dt.29-01-2016 2/2 to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Aditya Kr.
