JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-05-2023 The limited prayer of the petitioner in the present writ petition is to direct the Circle Officer, Kuchaikot, DistrictGopalganj, to dispose off the pending encroachment Case No. 10 of 2022-23.
The learned counsel for the Respondent-State submits that in case the aforesaid encroachment case is still pending, the same shall be concluded within a stipulated time frame as fixed by this Court.
Having regard to the facts and circumstances of the case, I deem it fit and proper to dispose off the present writ
Patna High Court CWJC No.15505 of 2022(2) dt.11-05-2023 2/2 petition with a direction to the Circle Officer, Kuchaikot, District-Gopalganj, to conclude the proceedings of the aforesaid Encroachment Case No. 10 of 2022-23, if not already concluded, by passing the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, in accordance with law and after hearing the affected parties, within a period of six weeks of receipt / production of a copy of this order.
