Civil Writ Jurisdiction Case No.1455 of 2016 ====================================================== Madan Lal Mandal .... .... Petitioner/s
Versus
Ashok Kumar & Ors .... .... Respondent/s ====================================================== Appearance :
For the Petitioner/s : Mr. Md. Qumrul Hoda For the Respondent/s : Mr.
====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 12-07-2016 Heard learned counsel, Md. N. Hoda, appearing for the petitioner.
2.
Perused the order dated 31.08.2015 passed by the learned Additional District Judge-IV, Katihar in T.A. No. 02 of 1998.
3.
It appears that the application under Order 41 Rule 27 C.P.C. was filed by the petitioner-appellant praying for setting the judgment of the trial court and for remanding the matter to the trial court on the ground that no proper cross-examination was made by the petitioner-appellant to the witnesses of the other side. 4.
Considering the nature of relief claimed and the reason assigned by the court below, in my opinion, it is not a fit case for interference in exercise of supervisory jurisdiction. Thus, this writ application is dismissed.
