The petitioner seeks regular bail in Fulwariya P.S. Case No. 149/2018, registered for the offences punishable under Sections 120(B), 414 and 34 of the Indian Penal Code and section 30(a) of the Bihar Prohibition & Excise Act. In the written report it is alleged that two vehicles Scorpio and Swift Car have been intercepted by the police and total 86 litres of illicit foreign liquour was recovered from the vehicles. Petitioner and other persons were sitting on those vehicles.

Learned counsel for the petitioner has submitted that other accused persons with similar allegation have been granted bail by different Coordinate Benches of this court vide order

Patna High Court Cr.Misc. No.3544 of 2019(2) dt.01-02-2019 2/2 dated 18.01.2019 passed in Cr. Misc. No. 78571/2018, order dated 15.01.2019 passed in Cr. Misc. No. 79637/2018 and order dated 15.01.2019 passed in Cr. Misc. No. 1791/2019. Petitioner is in custody since 03.11.2018.

Considering the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge II-cum-Special Judge Excise, Begusarai in connection with Fulwariya P.S. Case No. 149/2018 subject to the condition that both the bailors will be close relative of petitioner.
