JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 20-08-2016 The petitioner was appointed as Correspondence Clerk in the Marketing Board and after dissolution of the Marketing Board, his services was absorbed in Agricultural Department, Sherghati on 24.03.2009, from where the petitioner retired on 30.06.2011.

A Counter Affidavit has been filed by the State observing that the payment of arrears of GIC and Salary have been paid to the petitioner through his PRAN AC YPR 4201 Q. It has been stated that the petitioner is not entitled to any Gratuity and Pension as per circular (amended) of the New Pension Scheme of the year 2005.

The petitioner disputes the statements made in para-9 of the Counter Affidavit that he has been paid arrear of his GIC and Salary.

If the petitioner files a representation before the Respondent No. 2 stating that he has not been paid his arrears of GIC and Salary, the Respondent No. 2 would ensure that the same is paid to him, if not already paid, within a period of two months from the date of receipt of representation filed on behalf of the petitioner.

With the aforesaid observation and direction, the writ application is disposed of.
