The prayer in the writ petition is for quashing the notice dated 06.11.2013 issued in B.L.D.R. Case No.200/2013-14 by the respondent no.4 under the Bihar Land Disputes Resolution Act, 2009, by which the petitioner has been asked to appear. In the considered opinion of the Court, there cannot be any occasion to interfere in the matter when only a notice has been issued for a party to appear before the Authority. Faced with the situation, learned counsel for the petitioner prays that he may be permitted to withdraw the writ
Patna High Court CWJC No.7437 of 2016 dt.23-05-2019 2/2 application so that he may appear in the case with liberty to approach the appropriate forum, in accordance with law, if any order adverse to his interest is passed in B.L.D.R. Case No.200/2013-14.
In view of the aforesaid, the writ application stands disposed of as withdrawn with the liberty aforesaid. In case the petitioner appears pursuant to the notice impugned, within three weeks from today, along with a copy of this order, the case wold be heard and decided on merit.
