ANJANA MISHRA ORAL ORDER 05-01-2016 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Adapur P.S. Case No.153 of 2015 (G.R. Case No.732 of 2015) for allegedly having committed the offences under Sections 447, 341, 323, 324, 354, 307, 504, 506/34 of the Indian Penal Code and Section 3/4 of the Prevention of Witch (Daain) Practices Act.
Learned counsel for the petitioners submits that the
Patna High Court Cr.Misc. No.57462 of 2015 (2) dt.05-01-2016 2/2 informant and the petitioners are agnates and they have been on litigating terms since long. He further submits that a case, bearing Adapur P.S. Case No.156 of 2015, was also registered on 6.9.2015 just after the present case in which the date of occurrence is prior to the present occurrence. Considering the nature of allegations and the parties have been litigating with each other for one or the other reason which is more or less a family dispute, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.
10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Shri N.K. Priyadarshi, learned Judicial Magistrate, 1st Class, Raxaul at Motihari, East Champaran, in connection with Adapur P.S. Case No.153 of 2015 (G.R. Case No.732 of 2015), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
