Petitioners being the parents of the husband of the victim are languishing in custody since 23.02.2016 in a case registered for the offences punishable under Sections 498A, 304B, 120B of the Indian Penal Code.

The basic accusation is of torture and killing the daughter of the informant after two years of marriage for non-fulfillment of dowry demand.

Learned counsel for the petitioner submits that the victim died on 01.06.2004, when the present Complaint was filed on 07.06.2004, which came to be registered as Police Case on 15.07.2008. On the alleged date of occurrence U.D. Case No. 02 of 2004 was registered at the behest of informant. Initially the witnesses have not supported the accusation of

Patna High Court Cr.Misc. No.17002 of 2016 (2) dt.19-04-2016 killing. The informant has retracted from the initial version and filed a petition to that effect before learned court below. Considering the delayed lodging of the case, at earlier point of time U.D. Case was registered at the behest of the informant and retracted version of the informant, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Shri Neeraj Kishore, J.M., Ist Class, in connection with Babubarhi P.S. Case No. 147 of 2008.
