1. Withdrawing the writ petition learned counsel prays that he should be allowed to file an appeal before the Appellate Authority i.e. Special Secretary in terms of Section 28 of the Bihar State Madarsa Education Board Act, 1981.

2. Considering the provisions contained under Section 28, the petitioner is granted liberty to withdraw the writ petition and prefer an appeal before the Special Secretary Bihar State

Patna High Court CWJC No.14898 of 2022(2) dt.09-11-2022 2/2 Madarsa Board Education Department.

3. If such an appeal is preferred the same shall be decided on merits after giving opportunity to the other side within period of 60 days from the date of filing of the appeal. It is need not be mentioned that the case shall be decided on merits without delving on the issue of delay.
