1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 341, 323, 324, 307, 379 and 34 of the Indian Penal Code.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and the informant
Patna High Court CR. MISC. No.63293 of 2024(3) dt.17-12-2024 2/3 alleges that on 25.03.2024, the son-in-law of Rameshwar Ram took his nephew to the house of Rameshwar Ram, where from before other accused persons were present, further Bijendra Ram (petitioner no.7) caught his nephew and Sunil assaulted him by knife causing injury on his eye, further Urmila Devi snatched golden chain worth Rs.45,000/- from the neck of Jyoti Kumari.
4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case with general and omnibus allegation. It is next submitted that Sunil is not a petitioner in the instant anticipatory bail application and there is no specific allegation of assault against any of the accused persons. As far as Bijendra is concerned, he has been implicated in the instant case with an allegation that he caught his nephew, when Sunil assaulted him by knife.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/-
Patna High Court CR. MISC. No.63293 of 2024(3) dt.17-12-2024 3/3 (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned trial court where the case is pending/successor court in connection with Mohammadpur P.S.
