JUSTICE SUDHIR SINGH ORAL ORDER 08-03-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 341, 323, 324, 307, 379 and 34 of the Indian Penal Code.

Allegation against the petitioner is that he along with other accused assaulted informant and also snatched his money and mobile phone.

It is submitted on behalf of the petitioner that he has been falsely implicated in the present case. There is admitted enmity between the parties. From perusal of the injury report it appears that it is a superficial injury on the victim. On behalf of the State, it is submitted that petitioner is named in the F.I.R. and there is direct allegation of assault against him.

Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner, same is rejected.

Any how, if petitioner surrenders in the court below, i.e., A.C.J.M., Danapur, Patna, in connection with Bihta P. S. Case no.

Patna High Court Cr.Misc. No.57702 of 2015 (2) dt.08-03-2016 2/2 389 of 2015 within a period of six weeks from today and pray for regular bail, same shall be considered and disposed of on its own merit without being prejudiced by this order. (Sudhir Singh, J) sudip/- U T
