After some arguments, the learned counsel for the petitioner prays for withdrawing this application to file a fresh anticipatory bail petition before the Principal District Judge, Gaya in view of the fact that earlier the other side had settled the matter but now they are not appearing before the court below.

3. If such an application is filed, the same shall be considered by the Principal District Judge, Gaya on its merits.
