1. Heard learned senior counsel for the petitioners and learned APP for the State.

2. The petitioners seek bail in anticipation of their arrest in Bhaptiyahi P. S. Case No.88 of 2025 registered for the offences punishable under Sections 96 and 3(5) of the B.N.S.

3. The learned senior counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that his minor daughter aged about 15 years was going to the shop from home to give food to the informant, but she did not come. On enquiry, it transpired that petitioners have kidnapped the victim.

4. The learned senior counsel for the petitioners

Patna High Court CR. MISC. No.57752 of 2025(2) dt.04-09-2025 2/3 submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that no doubt, the victim in her statement recorded under Sections 180 and 183 B.N.S.S. has supported the case of the prosecution and has stated that the petitioners were involved in her kidnapping and subsequently she was handed over to Ravindra Kushwaha, who made her unconscious administering something to her and took her to his home at Madhya Pradesh by bus and forcibly performed marriage and thereafter for two months, he repeatedly committed sexual harassment, but then, subsequently the victim has filed an affidavit before the Court wherein she has stated that petitioners have committed no occurrence with her and the case was mistakenly filed against them.

5. Learned A.P.P. Sri Chandra Bhushan Prasad opposes the anticipatory bail application and submits that the victim in her statement recorded under Sections 180 and 183 B.N.S.S. has supported the case of the prosecution and the affidavit came to be filed subsequently and there can be varied reasons for filing subsequent affidavit. It is also submitted that investigation is continuing.

6. Considering the submissions made by the learned A.P.P., the Court is not inclined to extend the privilege of

7. The prayer of the petitioner for anticipatory bail stands rejected.
