This application, for grant of anticipatory bail, arises out of Kanhauli P.S. Case No. 7 of 2016, disclosing offences under Sections 147, 149, 341, 323, 324, 307 and 504 of the Indian Penal Code.
The occurrence appears to have taken place because of matrimonial dispute between 28 persons including the informant and others. There are 28 persons named in the F.I.R. including several ladies, who are said to have assaulted the informant.
Learned counsel appearing on behalf of the petitioners
Patna High Court Cr.Misc. No.17824 of 2016 (4) dt.12-07-2016 2/2 has submitted that the allegation against the petitioner no. 1 is that he assaulted the informant with a Farsa and the petitioner no. 2 assaulting the informant with iron rod. The injury, according to him, has found to be simple in nature. Considering the genesis of the occurrence and the nature of allegations, this application is allowed. Let the petitioners, above-named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sitamarhi, in connection with Kanhauli P.S. Case No. 7 of 2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
