JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 03-04-2023 Heard the learned counsel for the petitioner as well as Mr. J.N. Thakur, learned APP for the State. In this case, the petitioner is seeking regular bail in connection with Tilauthu P.S. Case No. 161 of 2020, registered for the offences punishable under Sections 387, 506, 120(B)/34 of the Indian Penal Code and Sections 14,16,18,20,40 UAPA Act.

As per prosecution case, 12-15 unknown persons variously armed came to the construction site and threatened the informant and other staff and they demanded levy from them. Learned counsel for the petitioner has submitted that the petitioner is under custody since 05.03.2022. There is nothing against him except his confessional statement as well as

He has also submitted that on similar footing co-accused Ajay Kumar Singh and Chhotu Yadav have been granted bail by coordinate Benches of this Court in Cr. Misc Nos. 28708 of 2021 and 43405 of 2021 respectively.

On the other hand, the learned APP, Mr. J.N. Thakur has opposed the prayer for bail and submitted that the other accused persons and the petitioner himself rendered confessional statements confessing their guilt. Considering the above-mentioned facts and circumstances, especially the fact that other co-accused persons on similar footing have been granted bail, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M. Rohtas at Sasaram in connection with Tilauthu P.S. Case No. 161 of 2020, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to
