2. Learned counsel appearing on behalf of the petitioner informs that petitioner has filed appeal against the penalty order contained in Memo No.7223(E) dated 21.11.2023, before the Appellate Authority (Respondent no.2) and same is pending since 11.12.2023.
3. Considering the aforesaid information, I find it
Patna High Court CWJC No.13974 of 2024(2) dt.17-09-2024 2/2 proper to direct the respondent no.2 (The Additional Chief Secretary, Road Construction Department, Government of Bihar) to take a conscious decision in respect of appeal filed before him by the petitioner, expeditiously, as he has already failed to pass a necessary order in accordance with statutory time, as contained in Bihar Government Servants (Classification, Control & Appeal) Rules, 2005.
4. With the aforesaid observation/direction, the present writ petition stands disposed of.
