JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-01-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 504, 506, 353 of the Indian Penal Code.
The prosecution case is that the petitioner being Circle Officer, Sonbarsa has been manhandled by the petitioner being Pramukh of Sonbarsa Block.
It is submitted by learned counsel for the petitioner that since petitioner did not succumb to the request of the informant with regard to payment under Backward Regions Grant Fund(BRGF), hence maliciously the case has been lodged. Moreover the petitioner has also filed Complaint Case No. 1247 of 2015 against the informant.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the nature of accusation in the
Patna High Court Cr.Misc. No.279 of 2016 (2) dt.06-01-2016 2/2 backdrop of dispute between the informant being Circle Officer and the petitioner being Block Pramukh, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Pupri at Sitamarhi in connection with Sitamarhi P.S. Case No. 115 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
