JUSTICE AHSANUDDIN AMANULLAH ORAL JUDGMENT Date: 25-11-2016 Nobody appears on behalf of the petitioner. Learned counsel for the State is present and has assisted the Court. The petitioner has moved the Court for quashing of the alleged compromise before the Shanti Samittee constituted by the District Magistrate-cum-Collector, Kaimur dated 30.11.2013 and also for a direction to the authorities not to interfere in his personal matters including those relating to property. Learned counsel for the State submitted that the petitioner has grievance against respondents no. 4, 5 and 6 and respondent no. 4 is his mother whereas the respondents no. 5 and 6

Patna High Court CWJC No.9520 of 2014 dt.25-11-2016 2/2 are his sisters. He reeferred to the averments made in the counter affidavit filed on behalf of the respondents no. 2 and 3 and submitted that with a view to maintaining peace, Shanti Samittees were constituted by the District Magistrate in all the villages and in the present case also the matter was brought before the Shanti Samittee and the parties agreed to the terms and conditions on which the petitioner has also signed, on his own free volition without any coercion. It was submitted that there is no occasion for the District Administration to intervene in the matter as it is purely a private dispute.

On 27.10.2016, on prayer made by learned counsel for the petitioner, the matter was adjourned, with liberty to file rejoinder to the counter affidavit filed on behalf of the State. Today, neither rejoinder has been filed nor anybody appears to press the writ application. In view of the aforesaid, the Court can only presume that the petitioner has lost interest in the case. Accordingly, the writ petition stands dismissed for non prosecution.
