The petitioner is languishing in custody since 27.11.2018 in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It is alleged that from the possession of the petitioner, 13.500 litres of illicit foreign liquor were recovered. It is submitted by learned counsel for the petitioner that merely on the basis of suspicion the petitioner has been arrested in the present case and the petitioner is accused in one another case of similar nature.

Learned APP submits that the recovery has been made from the possession of the petitioner.

Patna High Court Cr.Misc. No.5077 of 2019(2) dt.30-01-2019 2/2 Considering the quantity of recovery and the period under custody, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 11272 of 2018, arising out of Jehanabad Rail (Taregana) P.S. Case No. 87 of 2018.
