JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-09-2019 This application, for grant of anticipatory bail, arises out of Bhabhua Mahila P.S. Case No. 28 of 2019, disclosing offences under Sections 498A/34 of the Indian Penal Code.
Petitioner happens to the husband of the informant and allegation against him is of subjecting the informant to torture with respect to demand of dowry.
Submission of learned counsel for the petitioner is that he is ready to keep in the informant-wife with full honour and dignity and entire allegation is false and concocted. Heard learned A.P.P. also.
From perusal of the record, it appears that before the learned Sessions Judge, the petitioner flatly refused to keep the informant with himself and apart from that there is allegation
Patna High Court CR. MISC. No.56614 of 2019(2) dt.06-09-2019 2/2 against the petitioner of torturing the informant with respect to non fulfillment of demand of dowry. As such, I am not inclined to grant the privilege of anticipatory bail to the petitioner. However, it is open to the petitioner to approach opposite party no. 2 and persuade her to reside with the petitioner and, thereafter, pray for regular bail before the court below and court below after verifying the same from the informant, shall pass an appropriate order.
