2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 363, 365/34 of the Indian Penal Code.
3. As per allegation in the FIR, it is a case of abduction of daughter-in-law of the informant from her matrimonial home at night by three accused persons including the petitioner.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Victim girl and her mother have filed a compromise petition before CJM, Nalanda stating therein that victim was wanting to pursue
Patna High Court CR. MISC. No.62747 of 2023(2) dt.05-10-2023 2/2 her further studies but she was married by using force by her parents so she left her matrimonial house without informing anyone. Petitioner has got no criminal history and languishing in judicial custody since 24.6.2023.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJM 1st Biharsharif Nalanda in connection with Rahui P.S. Case No. 266 of 2023.
