JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-01-2016 Heard learned counsels for the petitioners and the State. The petitioners being the cousin brother, uncle, brotherin-law and cousin sister of the husband of the informant are apprehending arrest in a case registered for the offences punishable under Sections 323, 341, 342, 498A, 406, 384, 387, 420, 307, 354A and 509 of the Indian Penal Code. The prosecution case is that the informant was married with Vikram Sarraff on 23.01.2015 but thereafter she was being tortured for non-fulfillment of further dowry demand. The specific accusation of assault is against mother-in-law and husband of the informant.
It is submitted by learned counsel for the petitioners that
Patna High Court Cr.Misc. No.4384 of 2016 (2) dt.28-01-2016 2/2 the petitioners are distant relatives of the husband of the informant and maliciously they have been roped in the present case. Considering the relationship of petitioners with the informant and nature of accusation, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Lakhisarai in connection with Lakhisarai P.S. Case No. 253 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
