ANJANA MISHRA ORAL ORDER 04-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 18.07.2019 in connection with Misc. Excise 526/19, arising out of P.R. No.76/19 registered for the offence under Sections 30(A) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries of 18 litres of Nepali country made liquor were not from the conscious possession of the petitioner, but from the motorcycle, which is alleged to have been intercepted.

Considering the aforementioned facts and

No.55170 of 2019(2) dt.04-09-2019 2/2 circumstances and that the petitioner has no criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge-II-Cum Special Judge (Excise), Supaul, in connection with Misc. Excise 526/19, arising out of P.R. No.76/19.
