Patna High Court Cr. WJC No.413 of 2016 dt.04-07-2016 2/2 sheet, under Sections 302, 201 read with Section 34 of the Indian Penal Code, naming, amongst others, the present petitioner as accused.

With the help of this application, made under Articles 226 and 227 of the Constitution of India, the petitioner seeks reinvestigation of the case on the ground that he is innocent. The innocence and/or guilt of the accused is to be determined at the stage of trial unless the Court decides to discharge the accused upon perusal of the materials, which may have been collected during investigation. Having regard to the nature of grievances, which have been expressed by the petitioner, this Court is clearly of the view that no case for reinvestigation of the case aforementioned is made out. In the result and for the foregoing reasons, this writ petition stands dismissed.
