JUSTICE MOHIT KUMAR SHAH ORAL ORDER 29-03-2024 The present writ petition has been filed seeking the following reliefs:- "1(i). For quashing the order of Divisional Commissioner Saran at Chapra passed in Aanganwadi Revision Appeal Case No. 44 of 2021 on 04.08.2021 whereby and whereunder she has rejected the same just in mechanical manner in view of pendency a writ petition vide CWJC

Patna High Court CWJC No.20718 of 2021(2) dt.29-03-2024 2/3 No. 4765 of 2020 titled as Kiran Kumari Vs. The State of Bihar and others preferred by the petitioner before this Hon'ble Court. And also quashing the order passed by 1st Appellate Authority -cum- the District Programme Officer, Saran at Chapra passed in Aanganwadi Case No. 01 of 2021 on 15.03.2021 contained in Memo No. 537 dated 15.03.2021 whereby and whereunder she has also closed the proceeding of the said case just in view of the pendency of the abovementioned writ application. And also quashing the order of Child Development Officer, Mashrakh, Saran passed in Case No. 12 of 202021 on 24.12.2020 whereby and whereunder she has dismissed the Aanganwadi Case / claim of the petitioner relating to selection of respondent no. 10 whose for the post of Sevika for ward no. 8 of Gram Panchayat Raj Bangara under the Block of Mashrakh in the district of Saran.

(ii). And further for directing the concerned respondent to select the petitioner in the place of respondent no. 10 for the post of Sevika for ward no. 8 of Gram Panchayat Raj Bangara under the Block / Project of Mashrakh in the district of Saran because the selection of respondent no. 10 has maliciously made by the Respondents."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however,

Patna High Court CWJC No.20718 of 2021(2) dt.29-03-2024 3/3 seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law including that of filing a suit before the learned Civil Court having competent jurisdiction. Liberty, so sought, is granted. 3.
