2. Petitioner seeks regular bail in a case registered for the offence punishable under Sections 30(a) and 41 (i) of the Bihar Prohibition & Excise Act, 2016.

3 . As per the prosecution case , 17.7 litres of foreign liquor was recovered from two bags on spot.

4. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious possession of the petitioner and he has been made accused only on suspicion . Petitioner is in custody since 15.07.2024 . 5 . Learned A.P.P. for the State vehemently opposed the bail application .

6. Considering the nature of accusation and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Judge - 1 , Motihari East Champaran in connection with Sangrampur P. S. Case No. 79 of 2023 .
