JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 12-05-2016 Heard learned counsel for the petitioner and the learned Addl. Public Prosecutor, appearing on behalf of the State. This application for grant of anticipatory bail arises out of Complaint Case No. 363/2011, disclosing offences under sections 406, 323, 504/34 of the Indian Penal Code and section 3/4 of the D.P.Act.

Since the present application arises out of a complaint case, the petitioner is directed to appear before the court below and seek regular bail, if so advised. If he does so, his application for regular bail shall be disposed of on the same day in the light of the decision of this Court in the case of Salim Ansari @ Md. Salim Ansari & ors. v. the State of Bihar & Anr., reported in 2015(3)

This application for anticipatory bail is, hereby, rejected, but with the aforesaid observations.
