The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341/323/324/307/448/34 of the Indian Penal Code. The prosecution case is that accused persons entered into the house of the informant when petitioner no.2 Hiralal assaulted on the head of the informant with 'dagger', petitioner no.1 Motilal assaulted on the neck of Gautam with 'khanti' whereas co-accused Janki Mahto assaulted on the leg of the informant with iron rod. It is further alleged that petitioner no.2 Hiralal snatched earring-ring of Ansu Devi.
It is submitted by learned counsel for the petitioners
Patna High Court Cr.Misc. No.56704 of 2015 (2) dt.15-12-2015 2/2 that in the background of dispute with regard to passage accusation has been levelled. For the occurrence of 06.09.2015, the FIR was registered on 07.09.2015 at 14.30 pm. Moreover, a statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Nawada in connection with Nawada Town(Kadirganj O.P) P.S. Case No.595/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
